My father had owned a pagdi system house and a shop. Later he had rented both the house and shop to two different persons. The tenant have without our permission have sub-let both the properties to others since many years. Can we legally get the properties emptied from both of them and how? Also can we increase the rent to be taken from both of them and how? Both the tenants are taking more rent from the sub-tenants than what we charge from them. Also both the tenants are not staying at the said properties since long. My father had expired so now whether the ownership will go to my mother or my elder brother?

You can file eviction suit on the ground of sub-tenancy.
You can apply for determination of fair rent as well.

After the demise of your father the property would go to all legal heirs.
File suit of eviction on the ground of sub tenancy.

Your father himself owned a pagdi system property, it means it was not his own property?, it means he himself was a tenant in it?, if so, there are more legal tussles in this especially with the legal heirs vacating the so called tenants and his sub-tenants. Please contact a local lawyer and proceed as per his advise.
