Notice pay

(Querist) 11 October 2015 This query is : Resolved
I'm working in a company and gave resignation through mail and same was accepted. As per employment contract it was mentioned that "employee is having liberty to give notice period of 3 months or pay in lieu of"

But I want to serve for a week and ready to pay for the remaining period, the same was not accepting by my employer.

In this situation what I have to do
Anirudh (Expert) 11 October 2015
In other words, you do not want to pay for one week which you would be serving. By this, how much you would be saving? Please clarify.
NareSh (Querist) 11 October 2015
If I leave now least possible will get 30 percent extra apart that will get peace of mind.
Anirudh (Expert) 12 October 2015
You are not answering my query.
You say that you want to serve for one week (instead of notice period of 3 months).

That means you are ready to give to the company amount in lieu of 2 months and 3 weeks notice, and want to save money for the 1 week notice period which you want to serve.

I am asking what is the amount that you would be saving by serving only 1 week. In other words, what is the difference in amount (i) if you have to pay for the entire three months and (ii) only for 2 months and 3 weeks?

Whether provisions of partial purchage of notice period exist in the appointment letter?
NareSh (Querist) 12 October 2015
Serving one week is not to save, my new employer gave time till that.

Specifically there is no wording of partial purchase of notice pay

Pls give your valuable suggestions
Anirudh (Expert) 12 October 2015
If that is so, then pay the amount in lieu of 3 months notice period and go and join your new employer at whatever date that he has fixed for your joining.

Why are you unnecessarily harping on serving 1 week etc.?
NareSh (Querist) 12 October 2015
Any way I wanted to join, my question is that whether my act is proper or not as per the employment contract.

My employer wanted me to serve till replacement, but I can't.

Better pay three months pay and leave the company peacefully.
