It has been found that UAE employer (of Indian origin)retaining the passport of Indian fails to return the passport
despite the request.

Under no law a passport can be detained, despite which the passport are detained giving the reason of completing formalities.

Please advise, how an employee can get the passport and to whom the complaint is to be lodged.

Even me, as employee conveyed them to reimburse all the expenses in connection to that, the employer fails to return the pass port.

Pl. advise the status and save ..!!

You can make complaint to local embassy of India and Ministry of External Affairs, GOI.

dear visu,

do you have a proof of submitting the passport with employer, like a written receipt or acknowledgement?

It is understood that in gulf countries,it is a practice especially with regards to unskilled labours that their employers keep passports without any proof?

I wonder in such cases,how a complaint to the local embassy help?

There is no law to retain the passport of the employee by the employer except fot terms and conditions of the employment agreement othrwise laws does not permits.Incase of such harassment you can make local complaint as advised by expert Mr.Makkad.

I do fully agree that under no law passport can be detained by the employer.

However,it is a gulf country and before proceeding with legal remedy,it is advisable to seek the help of local embassy as any hurried action in this regard may endanger yourself.
