Guest (Querist) 06 September 2010 This query is : Resolved
Who are they ?

What legal powers they have ?

Who appoint them and why ?

What if,we disobey them ?

What benefit we laymen can get by appointing them ?

I have a very vague idea about them, please clarify.

Dear Anonymous,

In view of the provisions of Section 8 of the Arbitration and Conciliation Act, 1996 if any action is brought in the matter which is the subject matter of an arbitration agreement shall if a party so applies not later than when submitting his first statement on the substance of the dispute usually the concerned court directs that the matter in view of the contractual legal clause of Agreement amongst the parties to the dispute be referred to Arbitration.

For details kindly see Arbitration and Conciliation Act, 1996.

Best Regards

Daksh
