Submitting Original Docs in Court ?

Suppose,I submit original docs with my petition and then the same day take certified copies of all of these docs from the court,thereafter next day,can I deposit these certified copies with the court and take back the originals ?

Can u please suggest that whether this can happen or not?

Would the court allow me to do so ?

If yes,would the court ask me questions,why I am doing all this?

I wanna do all this to skip the exhibition of the docs,is it a right move ?

Yes. You can get back your documents by filing a petition before the concern court for return of original documents.. But its have some formalities. You can't get back in a single day. Cos thats not a stationary shop.. You have to given notice to other side.. They have to file a counter statements.. Then enguery.. Then order on your petition.. Its may be took some time.

One more thing, you wil file an affidavit along with your petition.. With that you have to stated your reasons for return of documents.. So you have to say the reason before arising question about the reason for return of documents.

My opinion is NO.

mere placing on record the original documents for a single day will not prove or authenticate the documents for judicial purpose.

if you need the originals with you then better place on record the attested copy the same. later you may show the originals to the court whenever demanded for judicial purpose.

You are at liberty to do it depending upon the need for the court to have the originals for judging the cause.You can file an application under Order 13 Rule 9 of CPC Proviso along with your affidavit containing the absolute necessity for the original. The court will certainly question you about the need for the immediate return which you have to explain satisfactorily. You can get certified copies only after exhibiting the documents in court and marking them by giving your oral evidence. You cannot get certified copies without exhibiting. Obviously you have raised the query under a misconception that you can get certified copies by merely producing the original in court. It is not so. Hence you cannot avoid or skip exhibition of them as desired by you.
