Apartment Query

(Querist) 30 December 2010 This query is : Resolved 
My brother wants to purchase apartment in Kasturi nagar bangalore which is BBMP approved. in approval plan parking lot has been shown in the stilt floor but instead aparments have been constructed in ground floor.flat which we r interested is in first floor.Also the floor plan of the flat is very different from approved bbmp plan.owner has khata and registration and loan from LIC is avaliable.will it be ok to buy this and what is the risk involved?

1- Stilt Floor is for parking only any part of Stilt Floor converted as Flat - avoid that Flat purchase

2- You may choose/have chosen Flat in First Floor -

3- Deference in between Approved Plan and Actual Plan- There appears to be Violation of Building permission Plan - it is common with all Builder with little variation - But that excess Plinth area can be regularized - at what costs/amount as penalties - to be enquirer !

thanks for quick and helpful response.just last clearification .in this apartment basement parking has not been given and ground floor is also used for constrution on the top of it 4 flors have been constructed as G+3 .just want to make sure that whole building does not become illegal and even if some akarma/sakarma happens for the building first floor owner will not be liable for any penalty.setback and open area has been left in apartment as per approved plan

Mr. Vishweshwar Rao has advised rightly.

In case of any violation of sanction plans, only builder shall be liable to pay penalty and to remove the un authorised structure.
