Dear concern,

My query is that we have our own house in the name of my mother after death of my mother the house is transfered four of us ( father, sister, me & brother) now we want to sell our house we 3 (father,sister n me) are agree for selling but my brother is not agree to sign. Kindly suggest us what to do because from others point of view it is disputed land..

your mother transfer her property yours four, if you want sale this house must to sign four members, if you can convince to sale or give lump sum amount.

Thanks expert for your advice but my query is still pending...

He said that he never sale this property at any cost or never leave while we providing funds to him.Is there is any solution to sale rest 3 parts of property.

you all three can sell your undivided share.

1. You, your father and your sister can sell the undivided 3/4th share of yours (1/4th each), or

2. You can offer your 3/4th share to your brother for sale at the market price, or

3. You may ask your brother to sell his 1/4th share at market price to you.

In case he accepts your offer to sell his share to you, you can sell the entire property as undisputed property.

You can file a suit for partition of the property be metes and bounds against your brother.
