proof of a court document

(Querist) 29 March 2011 This query is : Resolved 
A copy of agreement duly notariesd was filed in a court case but it was not exhibited. The fact of having the agreement entered into duly admitted by Plaintiff and Defendents by an affidavit filed in the court. The agreement is on the court file. The copy agency has denied the certified copy. Now how the document can be proved in another court case.

If the agreement is exhibited then its certified copy is permissible to be obtained. In alternative you can apply to et back the same for the purpose of exhibiting in another suit after replacing it with a photo copy.

YOU MAY FILE AN APPLICATION IN THE COURT MENTIONING ALL FACTS AND GET THE SAME EXHIBITED. IN CASE SOME PROBLEM THEN YOU MAY SUBMIT AN APPLICATION FOR EXAMINATION OF SAID WITNESS WHO HAVE SIGNED THE SAID DOCUMENT AS WITNESS AND PERSON WHO REGISTERED THE SAME.GOOD LUCK.

Mr. Devajyoti is right the certified copy can be obtained only when, it is exhibited. Thus you have only one option as suggested by Mr. Barman.

As long as the original is with the court, even though it is not marked as an exhibit, the court is bound to give certified copy. In many cases the court may ask to produce the originals in the IA enquiry. Those originals will be retained by the court, even though it was not exhibited, in that situation the court ought to give the certified copy.
