Departmental proceedings

(Querist) 16 June 2011 This query is : Resolved 
An inquiry officer was appointed to look into the charges framed against a Govt. employee under Rule 14 of CCS (CCA) Rules, 1965. Inquiry proceedings concluded after submission of written briefs of prosecuton as well as defence. However, before I.O could write inquiry report, he himself suspended after having been caught in a trap case. My question is:-
1. Whether he can write inquiry report during the period of his suspension or
2. Another I.O is required to be appointed by the disciplinary authority and
3. If another I.O is appointed, from which stage of inquiry will he proceed further in view of the fact that the proceedings have since been concluded.

1. Suspended Inquiry officer will not write inquiry report during the period of suspension.
2. Yes other Inquiry Officer will be appointed by the disciplinary authority.
3. The other Inquiry officer will start the inquiry from the stage at which the suspended Inquiry officer left the proceedings.
