Querist : Anonymous (Querist) 18 June 2011 This query is : Resolved
i resigned from IBM-Daksh after working for 8 months, and i was suppose to serve a notice period for 15 days but my manger told me not to do so beacause leaving a company on the 4th of next month will hamper their target and he told me they have the power to waive of the notice period, but after 45 days of leaving the company when i got my full and final amount in my bank account then i t was short of some Rs 6,000 and i discovered that it was deducted as i didn't serve the notice period for 15 days
and when i tried to contact to my manager about this then he refused to talk to me,
i do not want to loose my hard earned money so can u pls suggest me the few steps so that i can be paid for my work.

if you were duped by misrepresentation of your manager against an agreement in writting
then now in existing circumstances it would not be possible for you to prove that you did not serve 15 days notice because of oral assurance of your manager.
No body wants to loose in life, not even any body ready to pay for ones'own mistakes ,but it does go so that one has to pay for mistakes ,though unwillingly.
Forget it and enjoy peace that is more valuable than 6000/=,or get indulged to ruin some more money to gather with peace and invite tension.
Despite being a lawyer i advise you so that a decision with respect to any thing in life should be calculated on the scale of risk reward ratio, which i find not in your favor.

The company is having the right to claim the money in lieu of the notice period.
