I want recent case laws on eviction of tenant who is not paying rent and is not residing in the lease property.there is no lease agreement

in absence of an agreement,he is to be treated as tenant month to month.Terminate his tenancy by serving a notice of demand of rent due and vacation of premises giving him one month time,under transfer of property act.

Not paying rent and not in possession is a good reason for eviction.

Non user and defaulter in paying rent both are good grounds for eviction. It's a matter of proof. If both the grounds proved by you you dont need any citation.

in the absence of ny agreement non payment of three consecutive month rent create ground fr eviction..hwever if th tenent is
nt residing in th said permises fr thre consecutive mnth or is disapeared for th said duration you can aproach to th PS and can delock th premise fr nxt tenant or prsnl use or any sch wilful act of ur interest in ur property

Just give legal notice through an Advocate and give 15 days time to the tenant.
It is enough to evict him.
