Whether it is government bus or private bus, if the capacity is exceeded, you can file a petition.

Case against whom? There should be a common sense to the passengers, driver and conductors, as well as to the government. But who having that? For an example. You are waiting for the bus on bus stop. Already its late. Bus is coming with exact limit, thats 40 sitting plus 40 standing. Even you stopping bus, bus also stopped.. NOW WHAT WILL YOU DO? Will you get in the bus or follow the rule? Just answer this question. Then decide your self that case should be file against whom?

Agreed to MR. Ramchandran .. Its true that bus/ or other transport overload almost in every city ... number of seats can be the limit to board the passenger i.e. if the bus have 40 seats then the limit shall be 40 passenger but in practice it is quite tough to make it feasible as sometimes bus owner /staffs( wheteher gov. or private) do not comply and sometimes passenger do not object... but the exact question is to determine herein is whether it can be ignored in view of public safety? the answer could probably be a PIL in the apex court for the same praying for the guidelines to be laid down for every private/ govermnet transport in every part of india in terms of seats vis-vis passenger ... I think it would work ..
