Section 143 (2) of income tax

(Querist) 11 September 2011 This query is : Resolved 
Dear Sirs,

I am an salaried employee. I have returned my file for A.Y 10-11 in the month of June 2010 on the basis of my Form 16 issued by employer.
Now i have been issued notice from AO for further informataion.

I am unable to trace the documents for the H.R.A claimed as it was submitted to our company.
What would be the penalty in case of inability to produce documents demanded by A.O.

Do you remember that you claimed HRA from your company.
Do you know how much HRA that you claimed from your company.
Do you know whether you sought any exemption on the basis of the house rent paid by you over and above the prescribed limit of your basic pay?
Do you know that it is on the basis of your such declaration that your office might have effected TDS from salary depending upon your taxable income after allowing such exemptions.
Do you also realise that it is only the latest Assessment year for which the informtion is being sought.
Even if you don't have that documents with you, at least your office will be having such documents.
Than what is the difficulty in producing such documents. Unless, you claimed the banefits on the basis of some fake documents.
You have to come out with appropriate facts.

Your employer provided exemption in HRA only on submission of some rent receipts by you and other related information. The same are kept in office record, the copies of which you can request your employer to produce before the Assessment Officer.
