Crpc 125 warrant

Querist : Anonymous (Querist) 12 November 2011 This query is : Resolved
Respected Sir,

My wife filed a suit against me under CRPC125 and honourable Judge ordered me to pay Rs. 2500/m as maintenance to my wife (Rs. 2000 for my wife and Rs . 500 for my son (4 yrs old)). My Salary is Rs. 6000/m from all resources. Approx. half and a year is past for the order to make payment. As I made a revision for the same order where I was forced to pay the said amount. Failing my cause to make payment she then filed a suit under CRPC 125 3 and warrants are issued against me.
I dont want to make her any payment as I am ready to bring her back from the very beginning but she is always denying to come back without having any legal ground. Please do a favorable case reply to me as my next due date for case is near i.e. 28.11.2011 to appear before the honourable judge

as per my opinion revision may be accept only deposition of the money. if the warrant is issued then only deposition of payment is the option.
ajay sethi (Expert) 12 November 2011
you have to deposit the maintenance amount .
Devajyoti Barman (Expert) 12 November 2011
You can not escape the liability of maintaining untill you could dismiss her case which is however very unlikely.

you dont forget that your son is with her and how she maintain him without money. so pay your liabilities.
Devajyoti Barman (Expert) 12 November 2011
You have to prove that thing to escape the liability. Mere reproduction of words would not suffice.

See, the court has decided looking into the merits of the matter. Now, you need to pay or face imprisonment.
