Vlaidity of gpa in india

(Querist) 20 February 2012 This query is : Resolved
Mr. X stays in USA and he has given GPA to his father in law Mr. Y to register the House in Bangalore. Mr. Y has done so . Now what is the next procedure how to re register this house in name of Mr. X and what is the validity of GPA given by Mr. X to Mr. Y in this regard.
Khaleel Ahmed Mohammed (Expert) 21 February 2012
Query is not clear.
If X has given GPA to his father in law to purchase a house property in X name and father in law has purchased the same. There is no need to get registered again in the name of X by Y in this regard. The purchased property absolutely belongs to X only.
Raj Kumar Makkad (Expert) 21 February 2012
The contents of GPA shall decide the life of the GPA. If the same was given for the performance of a particular act of purchase of property then the same has already been performed and thus the GPA has expired but if no specific act or time was mentioned therein and the same was a general POA then it is still valid till the life time of either of the parties or till its revocation by X with due intimation to Y.
Deepak Nair (Expert) 21 February 2012
If Y purchased the property as the attorney of X, by way of GPA, then the propery will be registered in the name of X and not Y. Because X is the purchaser and Y is merely attorny who is representing X. Thus, there is no need to register the property in the name of X again.
