Anticipatory bail

(Querist) 08 April 2012 This query is : Resolved 
Anticipatory Bail Application u/s 438 Cr.P.C was dismissed by High Court. Can I file again the Anticipatory Bail Application before the Sessions Court. Please guide with with citation

Once AB is rejected by HC you have to go to SC only , can not go back to sessions court .

Follow MEHTRE case and more thereafter from SC and may get AB unless the offences and allegations are not more serious.

it is not useful because Public Prosecutor will produce the order of dismissal of the AB in the high court.

Not possible - there is judicial heirarchy whose propriety has to be respected. You made a mistake not approaching COS first. Now your only solace lies in an SLP before the Supreme Court.

Successive Bail applications can be filed though with the same court - but strictly only on change of facts - and not merely change of arguments. But the courts are loathe to entertain them for the reason that it directly reflects that earlier order was wrong.

anticipatory bail once rejected can not be again filed.filing same and again in either of them once already made i dont think is entertainable further.save rest better opinion..

But हमरे विचार से session court मैं regular bail प्रार्थना पत्र पद सकेला बाकी AB नहीं
