(Querist) 03 January 2013 This query is : Resolved
sir on my complain police have registered fir after 15 days.charges-406,411,423,421,465,120b.but i have come to know that i.o has been purchased and influenced politically to either submit final report or lighten up chargesheet.sir i have submitted few recorded conversations in which entrustment of property, and dishonest intention of the accused is clearly revealed.but i suspect that police may write statement(161crpc) of those whose conversation has been recorded, completely opposite to that of recorded conversation and as per wish of accused so that accused may be let free.sir i have heard that recorded conversation is a direct and substantiative evidence.sir what should i do if police records statement opposite to what is recorded in conversation .sir, please advise me

The statement u/s 161 crpc has not much evidenciary value.
If you notice any discrepancy in the investigation you can bring this to the notice of the Magistrate for proper direction.

The statements of the accused persons under section 161 are not recorded and if you do not feel satisfied with the final report of the police, you may move an application before the trial magistrate under section 173 (8) of Criminal procedure code for further investigation through an impartial senior IO and even then if you do not feel satisfied, file a private complaint.
