Gangster act

The Police has under section 173(8) cr.p.c. filed closer report finding the allegations as false in the case filed under Gangster Act and also in the single link case filed under IPC against the accused persons. Can the Special Court under Gangster Act consider to drop the proceedings independently under Gangster Act before framing the charges? The charge sheets have been submitted in the respective courts and cognizance has also been taken thereon but charges have not been framed yet in both cases.

Why not? When the Police who are the complainants themselves filed closure report, the Spl Court should discharge the accused person.
