Bond agreement

(Querist) 31 March 2013 This query is : Resolved
Sir/Madam,

I was working for a mnc company in Noida. And I signed a bond agreement of 18 months that said, if I fail to serve the company I have to pay Rs1,25,000. I worked for 10 months. But then could not continue due to health issues. I requested my HR to transfer me to my native place,Bangalore. But he refused saying they had no business opportunities there. I had no choice but to come back home. I did not resign but constantly requested for transfer. They sent a letter saying my records in the company will be closed on 7th oct 2012.
In the letter they mentioned I was not communicating with the company. But that was not true. My HR had stopped responding to my e-mails.
Now they are asking me to pay a amount of Rs1,45,000. I cannot afford to pay that amount. Please suggest a solution for my problem.

what were the health issues ? were you diagonosed with serious ailment ?

has company issued you legal notice? reply to notice that you are willing to serve for the balance period . deny your liabilty to pay the sum of rs 1, 45,000 .

mention that you could not attend office as you were diganosed with ______ illness and were undergoing medical treatment

I did not have any serious ailment. I had become very weak because I was not able to adjust to the weather. I sent a medical document that said I was suffering from viral fever.
And also I had some family problems that made me difficult to continue my job in Noida.
But my HR sent a mail saying 'you have to come back to your work location'. And then stopped responding.

viral fever does npot last for more than a week . contact the mangament and request for an amicable solution to the problem .

I have already done that. But did not get any response. So I joined a company in Bangalore last month. They've not yet issued any legal notice. I also consulted a lawyer here but her solution dint satisfy me. She told me not to accept any letters from the company, reject all the registered post saying 'person not available'. What is your opinion about this?
prabhakar singh (Expert) 31 March 2013
That is not the right way to response.should there come any notice, receive and deny as per facts of your case.
Devajyoti Barman (Expert) 31 March 2013
contact local lawyer if you are not satisfied with the reply here.
ptc (Querist) 31 March 2013
I know, escaping is not a solution to the problem. What else can be a solution?
ptc (Querist) 31 March 2013
local lawyer's suggestion dint satisfy me. The company is repeatedly sending me letters, asking me to pay the money. what should I do? Receive the letters or reject it?
And what is the next step if I receive the letter?
ptc (Querist) 31 March 2013
Please suggest me a suitable solution.
I want to know whether this problem will affect my current job?
ajay sethi (Expert) 31 March 2013
receive letters . reply to them
ptc (Querist) 31 March 2013
what should i say in response? Im not able to pay that amount?
ptc (Querist) 31 March 2013
Please suggest me a response to the letters.
Raj Kumar Makkad (Expert) 01 April 2013
You should ignore those letters and let the company file a civil suit for recovery against you before proper court of law and till then become ignorant about any corrrespondance from your previsou employer.
ptc (Querist) 03 April 2013
Sir,
I received a notice of demand from lawyer on behalf of the company. It says I have to pay the amount within 21 days from the date of the notice.
Suggest me a reply for this notice. Should I consult any local lawyer and reply through him?
