Power of attorney stamp demonination

Guest (Querist) 17 May 2013 This query is : Resolved
Its Urgent actually!!

Ref - PoA for NRI for availing home loans

Kindly advise what is the minimum (or right) denomination of STAMP on which the PoA is to be notarized.
Also please advise:
- Does the photograph of the principal and actor is mandatory for making the document right
- Is it necessary to REGISTER the PoA document, any issues if it is only notarized.

Someone kindly advise at the earliest, as this is very urgent for me.

Thank you in advance

in maharashtra power of attorney has to be on Rs 500 stamp paper .if power of attorney is for selling property it needs registration . for merely availing home loan registration may not be necessary .

register POA.

You have to get a notarized unstamped PoA from NRI on plain bond paper and the PoA has to go through what is called "validation process" at the appropriate Sub-Registrar's office. Contact the Sub-Registrar's office which has the jurisdiction at your place. Fees will be collected at the office.

Ask the NRI to get POA executed with is photograph affixed on it and authenticated by Indian embassy in the country NRI is.

Then present it before the sub-registrar's office in whose jurisdiction it has to be used, for adjudication and registration along with your ID and photograph.

If you prefer to keep it only notarized then the POA can not be used for buying and selling immovable properties. If that is not the purpose or right conferred under POA,it
may be notarized also.

I was referring to the procedure followed in Hyderabad. In fact I recently got a PoA "validated" as per the procedure I mentioned. In AP, PoA need not necessarily be certified by the Embassy or Consulate in the country concerned and it can be notarized. Better check with the Sub-Registrar's office concerned in your place. States may differ in this respect.
