(Querist) 13 September 2013 This query is : Resolved
G.m. to all of you. My client (education trust),Running a hostel, has paid tuition fees to Chartered Accountant for coaching classes services. whether Tds would be deductible in respect of professional fees paid to C.A.?
Sankaranarayanan (Expert) 13 September 2013
yes for all professional fees tds should be detected. more over you have to pay the service tax on the professional service
Rajendra K Goyal (Expert) 14 September 2013
Agree, nothing more to add.
R.V.RAO (Expert) 19 February 2014
yes is the answer to all parts of your query.
even if your client paid the c.a as
a professional or
as educational consultant or
as an outside professional teaching expert,TDS@10% is attracted.
the sec.is 194(j).
very recently CBDT gave a circular that service tax part in the fees will not attract TDS ,if the serv.tax claimed separately and if the contract so stipulates.
earlier people used to deduct TDS on service tax also
