Whther the biological son could be deprived of properties?

(Querist) 23 September 2013 This query is : Resolved
The adopted son was bequeathed with ancestral properties depriving his biological son in a christian family. Is the will to this effect is Valid? Can the biological son get over the blockade and get his rightful share. The father is alive.

1. IF the Will-maker is alive, THEN the question of "depriving biological son of ancestral properties" DOES NOT ARISE.

2. IF the property is conclusively proved as "Ancestral", THEN during life-time of the Will-Maker, the biological son may consider filing "partition suit" before the district civil courts, for his rightful share of the ancestral property.
