my empolyee has got the room under SRA scheme. unfortunatly her father expired before she got the possission.
now neither builder nor the so called secretary is cooperating in getting the room in the name of her mother or elder brother. No any allotment letter is given and other documents so that can transfer their adress in Ration card or can get electricity bill in their name.
the employee is the real needy and require assistance from the intellectuals without spending much.

Is any column of nomination was in the SRA Scheme? if yes, then according to that you send letter to your builder and secretary by the help of local lawyer.

Continuous follow up with the concerned is required. You can get the legal heirship certificate from Tehsildar office and on the basis of this certificate can proceed. This certificate is not time and cost consuming.

thanks for your comments on the succession certificates
the main problem is that neither the builder nor the secretary is cooperating in the matter.
for the succession certificates at least possessionletter is requires asb commented by our advocate
but bulder is not cooperatin in the matter and the entire tenants are sitting talkless . no body wants to initiate in the matter. since they fear that thay vcan be targetted.
want the detailprocedure step by step .
they have names in the SRA [mhada] list
they have old agreement with the builder they have ration card with the old adreess , adhar card on the new adress. bank pass book on the new adress.
now what else are reqd. pls advice in the matter . and procedure step by step so that matter can be resolved .
After getting the heirs certificate what else is reqd. and the total Amount reqd.

IF THE NAME OF FATHER IS IN THE APPROVED LIST BUILDER IS BOUND TO GIVE POSESSION OF FLAT TO THE FAMILY OF THE DECEASED .
ADDRESS LETTER TO BUILDER ENCLOSING DEATH CERTIFCATE OF THE DECEASED AND FOR ALLOTMENT OF FLAT TO THE MOTHER . ENCLOSE COPY OF noc FROM OTHER LEGAL HEIRS . IF BUILDER DOES NOT REPLY ISSUE LEGAL NOTICE TO BUILDER .

1. Who are they?
2. Agreement made between whom? Kindly clear it.
3. There is no problem if the agreement holder reside at old place and now at new place. your employee have genuine proof of residence. Now only a declaration required as they have earlier at old address and now at new address.
In which matter you asked about amount?

builder has already alltted the room and the employee alongwith mother sister and brother residing in the same building.but the allotment letter is not yet issued by the builder to any one of the residence except the so called secretary. the room still in the name of builder. electricity bill from reliance is coming in the name of builder only .
for want of allotment letter they cannot get the electric bills in the of name her mother or any other member of faimily . they can not get the change in address in their ration card.
what is the procedure to get the legal heir certificate. after getting it what next can be done.
earlier post are very much clear to understand the problem
what is procedure for getting the succession certificate.
the entire process to get the room in her name be furnished .it is requsted

you have to move bombay high court to obtain succession certifcate in favour of legal heirs . pay the court fees . it generally takes around 6 months

maximum court fees is Rs 75,000 . it depends upon value of flat
