(Querist) 12 November 2013 This query is : Resolved 
In an offence u/s.420,467/34 ipc a minor amendment in charges was prayed and allowed u/s 216crpc. Amendment sought and allowed was already part of records and was within the knowledge of accused prayed only to have a harmony with FIR.Lower court, after amendment ordered for new trial without asking defence counsel how will the accused be prejudiced by amendment and without giving opportunity to prosecution to submit objection against retrial.Case has already been running for more than 13 yrs. Pl. advice how to file a revision petition against such arbitrary order that should be supported by useful citations.I shall be obliged to get an early guidance.
