(Querist) 08 February 2014 This query is : Resolved
i have filed petition in court to suspend the third punishment which is one among three punishments charged on me.Court gave order to suspend 3rd punishment also. The first two punishments are suspended by company itself. Company implemented court order after contempt case but it was not providing or promoting promotions which was held due to punishments(charge sheet). So now how i should approach to get all my promotions back.Even i Approach company to provide promotions which were on hold due to charge sheet file on me as of now all punishments were suspended.Company is not responding properly and not forwarding. Now all my punishments are suspended as i am not guilty. How I should approach with court order suspending 3rd punishment in hand.

Since punishments are suspended. technically the company can not withhold your promotion any more though they hardly do so.

You have to file another case for getting your promotions back.

No punishment can be awarded without going through the procedure and declaring you as "Guilty of (specific)charge ".
Submit an application to the court for implementation of court order and suspension of third punishment, if any.

Submit letter/ send notice to release the promotion, and if not released, file court case.

I apprehend it to be an academic query posted in raw language.

If not, what were the first, second and third punishments, on what date imposed on which charge/offence and on what date the punishments were suspended by the court, can you explain?

Also, please indicate whether the punishments were suspended or quashed by the court of law?
Sudhir Kumar, Advocate (Expert) 09 February 2014
The query indicates that the author is concerned in a disciplinary matter in private company and there is litigation.

Facts clear enough to understand the case worth giving advise are not understood.

A good question raised by Mr. Dingra on the subject issue namely: please indicate whether the punishments were suspended or quashed by the court of law? Whether the case was dismissed subsequent to suspension of punishment?
I go with Mr. Sudhir Kumar's opinion namely:Facts clear enough to understand the case worth giving advise are not understood. Therefore the author is advised to state facts for proper opinion.
Sudhir Kumar, Advocate (Expert) 10 February 2014
sorry for typographic error

I meant

Facts not clear enough to understand the case as facts worth giving advise are not understood.
