Rights in property

Hello

My aunt, who was Unmarried, died in Uttarakhand calamity.

She has not made any will of her property or not appointed nominee in some of the bank FDs.

Till date Uttarakhand Government has not Issue her Death Certificate.

She has 4 elder brother & 1 elder sister in her family, now who will be her legal heirs or who can claim rights in that property?

each brother and sister would have 1/5th share in the property of deceased .

You (all the legal heirs) have to apply for succession certificate and thereafter can claim the bank deposits, proportionate to their share.

Petition has to be filed in the civil court.

Take the help of the local Advocate who is dealing mainly civil cases. He will help you to complete the formalities.
