During 2008-09 we purchased automobile spares from Maharashtra to Karnataka. Invoice was raised charging cst @ 3% without mentioning against form-C. We didnt submit the C-form to the supplier. Now we have to face cst audit. Now my question is, Whether tax authorities can claim extra tax from us since c.form is not issued. I dont know the suppliers position whether he had paid extra tax or not.

Tax authorities can not ask for tax from the purchaser since the tax liability is in the hand of seller. Supplier can ask for tax since he must have paid the full tax in the case of non receipt of C Form from the purchaser.

You have paid the invoice as drawn by the seller. What is the problem for you?

Do you know Mr. R.K. Jain himself is a well known Tax Expert.
After reading his reply, you can either agree with his views or give your views. But instead of doing any such thing, you say "consult your tax consultant".
I am sorry, by such sort of reply, the Expert who has given the reply is being shown in a very poor light. Please avoid such answers. Yes, your said reply would be apt, in case nobody has answered the query. But in this case, an expert has already given a reply, which is very correct also.
