Please clarify

In elections, is wooing voter with money, liquor etc. a crime? Is it treated as bribe? What criminal action can be taken if it falls under crime.

Kindly clarify.

This will amount to bribery under section 171E of Indian Penal Code.

Section 171E. Punishment for bribery


Whoever commits the offence of bribery shall be punished with imprisonment of either description for a term which may be extend to one year, or with fine, or with both:

Provided that bribery by treating shall be punished with fine only.

Explanation-"Treating" means that form of bribery where the gratification consists in food, drink, entertainment, or provision.

Nothing will happened through legal action.It can be rectified in the society by way of advertisement.

I do agree with Khalee. It is part of the election. If these all facilities are not provided the voters ment for it will not come to vote then what about the candidates and party who depends on such voters, they will loose their entity.

If voters are lured by way of money and liquor by any candidate or his supporter then such candidate/supporter shall have to face case under RP Act apart from criminal action.
