Non releasing of increment.

Sir,
Iam working in a public sector bank as officer.
I have not recieved increment from the year 2001 onwards.
My personal request for increment is neglected.
My collegse are requested to me for not to go for litigation since it is againest mother institute.
All talks failed. I put reprentation 6 month back. But there is no reply.
In turn bank asked me evidence. That is salary slip. I have not preserved all my salary slip.
One copy of salary slip i presume it is with zonal office.
Mean while i was under transfer to various branch and to various regions.
In meanwhile i lost many documents.
Now iam coming nearness to my retirement.
Please guide me procedure i have to take in steps.

1. This is quite surprising.
2. The establishment department of your bank has all the pay details then why should they be asking for copy of the pay slips.
3. Make a representation to your officer's association to resolve the issue.

The bank is supposed to keep all salary records as is prescribed to be preserved for years together. So, they should not have asked you to provide proof. Rather, they should provide evidence, if increment had ever been drawn in your establishment bills from time to time.
You may adopt following courses:
(1) approach through employees union; and
(2) Use RTI to gather information about basic pay drawn from time to time as well as the rate and dates of increments drawn in your favour.

What was the reason of non releasing of increment ?
When you were appointed / promoted ?
In public sector Banks the maximum scale is reached in aprox. 16 years (for officer scale -I, may be earlier if special increments are earned due to qualification or CAIIB etc.) and after that only 1-2 stagnation increments are given after 5 years each reaching the maximum. Bank may withhold increment if any disciplinary case is pending against the officer.
Collect date of appointment / promotion / qualification etc and get the present position calculated from local public sector Bank officer of any Bank. In case of discrepancy, meet HR officer at Regional office.

Dear Rajendra,
I further give following information.
Date of birth-05-09-1956.
Date of joining bank-02-02-1979.
Date of promotion to officer cadre-19-06-2998.
Disciplinary action taken in the year 2000 for 8 months absence from duty..
Punishment given-reduction of rank by 2.
Increment not released since year 2001.
Please give me the best course action to be taken in steps.

Mr. Vinayak,
In your latest information, you have still not mentioned whether the you were reduced by two stages with or without cummulative effect. That is quite a crucial information to form any specific opinion, which you withheld. If orders specify reduction with cummulative effect, you may treat the effect of punishment till the end of your service.

even if the punishment was cumulative stil after end of penalty period the increment were to be given from which ever stage you were there.
