Kindly advise...
working for the past 2 yrs 4 mths with a pharma company.
understand the company not doing too well hence salary delays etc funds coming in are diverted towards company needs.
Last November 2013 salary was reduced by a different percentage this was intimated after the deduction took place for about 4 mths n promised to be reviewed and paid back however till dt no sign of the same. Salary was re-instated back in the next financial year with a promise of getting the same. Kindly note this was part of CTC.
Same was done with the bonus not yet paid being part of CTC.
Kindly advise at the earliest as facing serious financial problems due to committments emi's, late payments, penalties etc.
Management says you should make provisions which is not possible every month alternatively look out for other options this seems difficult due to age (46 - Secretarial Role outdated currently)
Understand an exit list is being worked out what the precautions or action that can be considered.
Please reply ASAP as i am the only earning member with 3 children totally dependant on my income.

Salary: Has to be paid on due date.The employee can lodge a complaint the moment payment of Wages is delayed even by a day and employer can be penalized say Rs 7500/instance.
No deduction other than statutory e.g. PF, ESIC,TDS ....can be made from earned wages....
It can't be reduced until you sign a concurrence.
Salary slip has to be issued at least a day before disbursement of Wages.
You may go through Payment of Wages Act:13A
Bonus: Statutory Bonus as per payment of bonus act has to be paid by 30 Nov or employer can be penalized.
You may be covered as 'Workman' as in ID Act,'Employee' as I'm Shops and Commercial Establishment Act..
Consult an able Labor Law Consultant Service matters lawyer, employees/trade union leaders ASAP....
It is in your interest to look for suitable employment in another company

If company is in financial troubles, your legal actions may not fetch desired results. Better switchover the company and fight for the arrears.
