Dear Sir,
I am using my surname as MALI (My full name is Suresh Kumar Mali)..My caste is MALI and Clan(Gotra) is SOLANKI.Both me and my wife using our surname as MALI..Now we want the surname for our child as SOLANKI..Could you please confirm can we update our name as below while applying for our child birth certificate:
Father Name :SURESH SOLANKI
Mother Name :CHANDRA SOLANKI
As our name in all identity document reflecting as Suresh Kumar Mali/Chandra Mali..So is there any afidavit or any document required for surname change of my child while applying for birth certificate
Also when I apply passport for my child using his birth certificate name as XXXXX SOLANKI so is this again create any problem ..At that time again any doc required to prove us surname not matching with our child's surname..Experts Plz suggest

You can have name of your choice for your son irrespective of your names or the so-called surname. It is purely a personal choice and Law has nothing to do with it!

You can use the name of your son with Solanki with your present name.
otherwise, both of you can proceed to get your name change procedure (sworn affidavit, newspaper publication, gazette publication) and get the documents prepared accordingly. Later submit the proof to municipal authorities for amendment / change in the birth certificate of your son.

first you need to change your and your wife name from mali to solanki . name change has to be published in offical gazette and 22 local newspapers . then only apply for brith certificate of your child with solanki name

What exactly you want? You want change in your/your wife's names also or only to include SOLANKI in your son's birth certificate. If you want only to include it in your son's birth certificate (for that matter his name), you both can keep your original surnames as these are reflected in all documents and you can name your son in whatever style you wish. There will not be any problem. But if you wish to include his parents name with surname SOLANKI in birth certificate, you need to change your name as per the provisions of Law suggested by the experts above. The procedure is a bit lengthy.

If you wish to maintain your names as SURESH SOLANKI/CHANDRA SOLANKI in child records, he will face the problem in future as your names supported by documents are different. Your thinking tentamounts to change of name of yourself and your wife. Please read again my reply and opt one of the suggestions.

Again one last Query Sir(malipeddi jaggarao )..
Can I use below name for my child birth certificate and all future record:
Child Name : XXXX SOLANKI
Father Name : SURESH Kumar Mali
Mother Name : CHANDRA Mali
In this case me and my wife surname will be remain same but child with different surname..
Can My child use the different surname for all his future record..

That is what exactly I suggested you. Legally there will not be any problem. Socially also, though your official name is Suresh Kumar Mali, you might be familiar as Suresh Kumar Solanki. Hence you should not have any problem. This is the simplest way to settle the problem.

If the child's birth certificate contains the parents names, I do not think it will create any problem.

There is Naming Act i.e., a law governing how a person should be named or what name should be assigned to a person; same principles apply to surname. It is open the parents to register their child's name with any surname or not to use any surname at all. There are many (including myself), esp. in the southern States of Kerala and Tamil Nadu who do not have any surname!
