Court Fee for HUF

Sirs

I am an Advocate. I want to know about the court fee for Rs.1,00,00,000/- for a Hindu Undivided Family. Dispute between three brothers reguarding property. How much Court Fee should be payable by the party against another party to file a suit.

For filing a suit for partition only the suit value(of your choice)is to be mentioned not necessarily the value of suit property. For example you can value the suit at RS.1000/- as well and pay the advoleram court fees on that value as per the rate as applicable to your State.

It is not the matter of choice of a person. If I value the property at Rs. 1/- then who shall beleive and why law of land shall permit it?

You have to value the property not at par with the current market value but at least on the rates when it was purchased and in the given case stamp duty/advolerum court fee is to be paid at 1/3 value of the property if only one sues others.
