Daughters share in father or forefathers property

Hello Sirs,

My Mother's brother (maternal uncle) has sold Agricultural land way back in 1995 after the death of my Grand Father in 1993. Grandma also expired, 4 year back.

Grand Father has 6 daughters and only son (my uncle), recently he came to us asking my Mom to sign on documents for the land which he has sold. And this is upon the fact that the person who bought the land need the signatures of all the 6 daughters of my Grand father (My Mom and my maternal aunts).

Do we have to sign this documents and for what purpose they need the signatures of My Mom and Aunts.

Please explain Sir..

Such a signature may not be required, unless your mom has share in the property.

If your mom has share in the property, then it is for your mom to ask for her share in the property, instead of simply signing. If she signs, then it means that she is party to the sale, and thereafter she cannot ask for any share in the property.

In any case, you have to approach a local lawyer, show all the property papers, discuss things and ascertain whether your mother has any share in the property.

What is the document that was placed before your mother?


The document to relinquish/gift/sell and even for POA shall need to be registered and the person has to appear before registering authority.



Your mother may very well have a share.

It is your mothers prerogative to collect her share or relinquish it.


Certainly opinion of an able lawyer specializing in family/revenue/civil matters and well versed with local laws should be taken.

Your mother has share in the property of her parents. Before signing discuss with your lawyer regarding the contents of the document.

Sirs,

Thank you for the replies. We do not have any proper documents apart from the survey number of the land what we know is only the survey number of the land and it is already been 20 years my uncle sold it some other person. Is it possible to claim the property and my uncle has not shown the papers to us yet.
