Process to close case in society

Hello,

WE had some issue with the society, but now we have resolved the matter with mutual consent. however the lawyer we appointed is not allowing us to close the case. Every time we get a date date he just extends it. Although the we have sorted the mutually with society, they have requested to close the case, after that we will be getting our Share Certificate. So my question is how can I get my case closed, with out the lawyer or the process to change the lawyer.

You may instruct the advocate in writing.

Or else, you can withdraw the vakalathnama, appear party-in-person and apprise the Court of the settlement.

Appear before the court and apply to withdraw the case.

Your lawyer is functioning as per your instructions and not vis-a-vis, i.e., your lawyer can advise you, however, it is your decision to act or ignore.
Inform the court qua settlement with the society and you do not want to proceed further.
