Dear Sir,
Can a member who has given his flat on rent and since many years not staying in the society is eligible to be office bearer of managing committee, when he is not available and approachable to society residents.

Sir,
The person whose name appears first in the Share certificate of the society can contest and can be elected to a post in the Managing Committee. The place of his residence is irrelevant.

Dear sir,
Place of residence is not in question. The members availability and reachable to society residents is a matter of concern. As he is not actively involved in society day to day matters. In a way we can call as inactive member.
According to me only such residents should be in managing committee who are associated with society residents and activities. This is not possible/justifiable if the member is residing else where and just owns a flat in the society and not approachable to society residents.
Your opinion please.

1. A registered member, has every right to contest his Society's elections, irrespective of whether he stays in the Society or not stays in the Society perpetually.
2. The voting society members decide whether he should be elected or not elected as a committee member.
3. The Mg.Committee minute book determine, whether he can continue to be committee member, within the parameters of the society bye-laws.
4. IF a committee member is "absent" (without leave), for three consecutive MC meetings, THEN he is deemed resigned /dismissed.

Your question is purely of an academic nature without discussion of any problem.
Further, do you believe that the members of the society are so dumb to have voted or would vote for a person to make him office bearer member of the management committee, when he is not available and approachable to society residents.
