dear experts
one of my frends taken a chequ from me about three years back and now he filed in a bank for rs 7,50,000/-alleging as a hand loan and filed a case in the court.how can i deal with the same.advice on this.thanq.

Ms.Pushpa Krishna, it appears it is a blank cheque and it was subsequently filled-in and presented to the Bank for payment and it was bounced, the payee has gone to court. Is not it? In such cases, you require to defend the case by engaging a good lawyer. The outcome depends upon the merits of the case, such as for what purpose the cheque was given, whether consideration can be proved, etc. There is a chance that the payee's case is weak if it not filled-in with your own hand-writing. One thing you agree, you have given a cheque - is not it? - In such case, better to request for a settlement with a condition to withdraw the case and pay him back his money.

Full material facts not disclosed. Other party has to prove your liability in the court.

A good lawyer can trap other party if the claim is false.

Generally such things not happen, whether you took some money from him and didn't returned, against which he used this cheque? Why such cheque was given to him, you have not mentioned?

Giving blank signed cheque to any person gives him power / authority to complete it and claim.
