Role of witnesses

(Querist) 12 September 2017 This query is : Resolved
Sir,

In a document registered in Tamil Nadu (not sure about other states) 2 witnesses sign on the document and 2 witnesses sign at the registrar's office

1. Do the 2 witnesses who sign on the document have to be privy to the contents of the document or are they just present to identify the executants?

2. Do the 2 witnesses who sign at the registrar's office have to be privy to the document or are they to just identify the executants?

Witnesses in such a matter need not be privy to the recitals of the deed in any case. Witnesses are required only to testify to the fact that they know and have seen the executants/persons signing on the said document at the time of execution or when the deed was made or came into effect...

It is not mandatory that the witness should be fully aware of the contents of the document.
