I had file a criminal case in court against the accused u/s 420 and 406. Recently the accused has submitted a fake evidence to get the benefit. Pl advice Can i file perjury on him u/s 340 crpc.

Sec 340 of Cr.P .C comes on effect when there is finding of cout that forged documents or fake evidence has been submitted by the party.

Very vague and premature query without making a mention about the present status of the case! Has the evidence been proved against the accused, as fake, and the judgment in the case pronounced on that basis?
It is the judge, who has to decide the evidence to be fake, not you.

Had the accused appeared as his own witness? Please note that information/explanation given to the Court u/S 313 does not constitute evidence and there could be no perjury even if incorrect or allegedly false information is given
