whether the accused may exhibit his document in 313

(Querist) 14 February 2010 This query is : Resolved
whether the accused may exhibit his documents in 313 of Cr.P.C. accused didnot want to testify himself.
Raj Kumar Makkad (Expert) 14 February 2010
yes. He can do so.
Parveen Kr. Aggarwal (Expert) 14 February 2010

A statement under section 313 of Cr. P. C. is not evidence nor the other party gets opportunity to cross-examine the accused. So, documents cannot be exhibited during the statement under section 313 of Cr. P. C.

If an accused wants to produce documents in his defence evidence, he can do so when the court grants him opportunity to lead his defence evidence.
Raj Kumar Makkad (Expert) 15 February 2010
I perfectly go with parveen.
