Property distribution

My husband had an agricultural land. As his brother is in need they kept the land papers in bank and got some money. Now we would like to divide the property between these two brothers, but as they don't have money we are not planning for the registration process. Is there any possibility that we can divide the property by entering the land details in a passbook even though the land papers are in bank. Is there any need of the land papers to make an entry in passbook

Unless and Until the Bank Loan is cleared and Original documents were obtained from the Bank No Partition Or No Transaction would be legally Allowed.Or Valid.

If the land belongs to your husband, why the partition with his brother?
