Dear sir
1. I would like to know that in case of deemed suspension (due to spending of more than 3 months in jail) review of suspension is required or not ?
2. And in same case can the suspension be revoked by the authorities, if the case is still going on in court and the verdict is yet to be delivered?

Dear Sir,
In case of deemed suspension or otherwise the suspension must be extended on expiry of particular period. But in must of the cases it is being violated and courts are not giving any relief even such lapse brought to then notice of the Court.

In a deemed suspension case, if police investigation is already over and the case is under trial in the court of law, but the accused is not in judicial custody, the suspension can be revoked by obtaining NOC from the police/ CBI/ ACB, as the case may be. But, if the accused is still under police or judicial custody, suspension cannot be revoked. Review after 3 months is a formality to take stock of the present status of the case for taking decision accordingly.
