Property purchasing

Hi guys,

I wanted to purchase flat in Bangalore and liked one property. I'm purchasing from the owner of that property not the builder and still waiting to proceed for purchasing but the problem is...
1. They don't have occupancy certificate (OC)
2. They don't have khatta paper.
3. Flat is in 4th floor but they have plan which mentioned even 4th floor.
4. They have sale deeds and recent tax pay.

Now the question is can I proceed forward or not?
If I proceed also I have some doubts to be clarified.
1. Can I get khatta n OC papers.
2. Can I get transfer it to my name.
3. How much will be the fees.
4. Procedure and time taken.
5. If I proceed to purchase will out be problem.

Now I wanted to know can I proceed or not. If yes then please provide me the details of the genuine person whom I can trust and follow up with providing me the proper documents.

Guys please give me the details if u had benefited from that person in providing all the documents. Hope u guys will help me out.

It is the builders responsibility to provide you with Occupancy certificate prior to yur stepping into your new flat. You check with hm.Regarding other papers also you can check with him.Elections and AGM have been held?You notify regarding your Khata papers problem to the Managing committee.One more certificate you need is completion certificate if all the work regarding Flat 8s completed you will have to apply to the Municipality for completion certificate..Also check wit your owner who sold the flat to you for occupancy certificate and Khata Papers.

So, even when you have so many doubts and questions, you will be asking the answers for them here and there, instead of approaching a lawyer in your area and consulting!
No wonder many of you suffer for your this shortcoming.
Better approach a lawyer in your locality and consult and get answers from him to all your questions and doubts.

Before taking any decision qua purchasing of the property you are required to spend few thousands of rupees as fees of a local prudent lawyer to find out title, claim, interest and/or encumbrance over the property.
However, do not rely upon FREE advise of experts/ impersonating expert on this platform since there is hardly any one (including yourself) have knowledge of factual position regarding the property.

You may draft IT again.
Rest your won counsel shall answer all Q if tile is clear and all approvals are available..
Obtain the legal opinion in writing.
