Loans and CC

Hi,

My friend took some cc and loan in 2006, which he not able to pay due to some unavoidable circumstances. But, later on they have settled most of their loans and cc.

One or two cards /loans are still pending. Recently, his father got a call, saying that he is the lawyer, who got his son case and he threatened his father that if u not pay the amount, they will get the arrest warrant against his son, they even published his picture in newspapers also to catch him.

My queries are :

Please let me know for how many years the case of default cc/loan is open, as he took the same in the year of 2006.

Can banks get Arrest warrant in this case?

Can they legally authorize to publish his picture and other details in the newspaper?

What actions can bank take in the default of loans/cc.

Please advise asap.

Normally ( please do not take my advise as advantage ) If no cheques are given and no cash payments are made for 3 years the Bankers of credit card can not make any claims legally. Only their collection agents would make such threats and you should not yield to it and handle it carefully. Even if you make a payment of Rs.100/- now your default would be revived and they could go for legal claims . Beware.

The loan stated to have been settled in the year 2006 has already been closed, if your statement is true.
Banks/money lenders do not enjoy the right to issue warrants of arrest of a borrower, if someone stated/ made such phone call it is "fake".
