Flood Insurance

(Querist) 31 May 2010 This query is : Resolved 
We have an Insurance Policy for special perils which covers Damage directly by flood, recently due to flood (just because of the flood) a few logs/boulders (floating in the flood water) damaged our assets, the Insurance company rejected our claim. Is the Insurance Company correct in doing so? Is there any way in which the claim may be obtained? citing of relevant caselaws will be more helpful.

YOU MAY FILE A CIVIL SUIT IN THE CIVIL COURTS AGAINST THE INSURANCE CO.YOU WILL SUCCEED.

on what ground the insurance claim was rejected?

usually many of the insurance companies have a claim review committe.

As such before filing a case,first sent an appeal to the claim review committe by regd post with a copy to the insurance ombudsman of your area.

Our claim was rejected on the grounds that the damage to our assets was caused by a boulder hitting the asset and not by flood. The policy covers damage caused directly by flood. but, as a matter of fact the boulder hit our assets only due to a flood in the region. the boulder could not have noved on its own. Please provide your views in this regard.

please file the appeal as suggested quoting the same ground for your claim by regd post and wait for their response.
