Attempt to Murder

Dear Friends,

We have dispute with our tenant who have filled case for permanent injunction and he get it.

now he is not paying electricity bill and 1 night when my Mother demand bill payment there some warm conversation happened and then the wife of Tenant take out the scissors and attacked on my mother by chance my mother spaced then the scissors went in street and shouted that I will kill you and then faint down.

we called the police and in her police statement she confessed that she said that either she call my mother or himself.

Now the problem is that police has not take any action against her and now they launched a false at police headquter complaint that we use to abuse him and beat him alot and she also filled a civil suit against me my mother and my fathers name.


Please tell me what action police have to take against the tenant wife who tried to harm my mother and what reply I should give to police head Quater about the false complaints.

If the Police is negligent or sitting idle over the complaint then you could go the nearest Magistarte having the jurisdiction to file complaint u/s 156(3)crpc contaning all the necesasry allegations so that the court sends the same to the concerned police station diirectnig it to make necessary investigation treating the said complaint as FIR of your case.

File a private complaint in the court.

I think its better for you to file complaint under section 190 Cr.P.C. and there after its concerning Magistrate's discretion that either he sent the complaint for register the case to the police station under section 156 (3) Cr.P.C. or adopt the procedure contained in section 200, 202 Cr.p.c.

If u can prove that she threw scissor and confessed in front of police, u can proceed.

Your case seems to be unbelievable. You have agreed that the tenant had obtained injunction. If the tenant is not paying the EB bill, will you go there demanding the EB bill receipt. The police may think that you are falsely creating case against the tenant to harass him. I don't think that you have genuine case.
