Dear Experts, Can a widow rightfully claim the residential property belongs to her In-Laws who are not permanent resident of the country. She had been occupying the residential property since the marriage to the deceased husband and paying the society maintenace since the last 10 years. What right she can claim for this residential property if In-Laws wants her to vacate ?

If in laws are the absolute owners and the property is self acquired then wife of deceased cannot claim any thing. To evict her from the house it needs genuine reason. Suit for possession can be filed.

If the widow have any minor children, she can claim the property on behalf of the minor children, not on her self as Mr.Rajoo advised.

I agree with Mr.Rajoo. She has no right over the in laws property. She can not misuse the affinity shows on her by the inlaws.

Thanks for your valuable opinions. I have further query to this. Can she take a stand that she is living at the house left by her deceased husband as she and her deceased husband only was staying at the said house after their marriage and it is now more than 10 years she had been in occupation of the said house and paying society outgoings by herself. Can she claim permanent right to occupy the house on this ground but that property is in the name of In-Laws and not in her deceased husbands name.
