how could a transport office be removed from residencial layout?

Honorable Expert,
i want to know the legal action which could be launched against a transportor who is running his office at residencial layout.
please, advise legal action and also administrative complains etc.

You can make a complaint to Sub Divisional Magistrate (Civil) of your area under section 133 of Criminal Procedure Code and also ca file a civil suit under section 91 of civil Procedure code with the permission of the court along-with one another person of your locality.

Since the office of a transporter is not a manufacturin unit , first check whether there is any bar in your state in running that type of office in your city/state. In west bengal, such type of office can validly be run from a residential area.

In my opinion, you may first give a representation (letter) to the Collector of your city narrating the problems faced by the public of the residential locality such as noise pollution, parking menace of lorries, trucks, etc., and request him to cause removal of the Transport office, and if the same is not acted upon by him, then you may file a Writ Petition u/Art.226 of the Constitution of India or a Public Interest Litigation (PIL) before the High Court for a direction to the Collector to consider the representation in public interest and welfare.
