Gpa query

(Querist) 01 October 2012 This query is : Resolved
Dear Team,

Is it compulsory that the person who accepts the GPA from the executor should sign on the GPA document?

The executor has signed the GPA and the Photos of the Executor and acceptor are present. But the signature of the executant is only present. Acceptor has not signed.

The executant and the acceptor have both signed in front of the notary , in the notary register.

Is it a valid GPA ?

It would be better if signed by attorney holder.

But lack of signature does not invalidate it.

This is the interesting question ? The registration act states for immovable property transfer case both the parties must sign.

For other instruments (GPA to do some act) Is it mandatory for beneficiary (donee) also to sign ? Can the registrar register the same if the signature of donor (executant) and witnesses are taken on record but the signature of beneficiary is not on the GPA ?

Will it be a valid GPA ? Request all Ld experts to give their views.
