Consequences of licensee after the leave and license peiod expires

(Querist) 06 March 2013 This query is : Resolved 
A Leave and License Agreement was entered and registered for a period of 36 months. The agreement Expired in the Month of Dec 2012. ON Feb 27th 2013, i received a notice of termination from the licensee. The Licensee has not paid me for the period of Jan and Feb2013. Is the licensee liable to pay for the month of Jan and Feb? If he denies, what action can be taken aganist him? How? Please Advice

At the time of delivery of possession adjust the rent of jan and Feb against security deposit.

Termination is automatic, as a period of LL was written in LL Agr.
If he did not vacate intime, and extend on his own, you can demand any rent, and compensation for losses incurred.

You can not only demand the mesne interest or benefits but also the double or triple of the normal rent as the license had already expired during the month of December and his subsequent possession was illegal over the property.

If he wants renewal to be done, insist him to get renewal of Leave & License for further period and get your rent regularly is also one option.
