Transfer

Does any law governs transfer of private employee. If conpany is doing forceful transfer. What could be remedies to get exceptions of transfer. What facilities a company should provide legally as a right in the favor of person to whom transferred.

There is no regulating body or provision of law regarding transfer of private employees. Only civil suit can be filed which is not all time or cost effective.

Go through the Standing orders of the company or your appointment letter and obtain the definite reply of your query thereto.

resign if you dont want transfer but if you want to save your job you will take the transfer

Law is well settled. Along with employment, employer gets implied right to transfer his employees, even if transfer is not express service condition in appointment letter or certified standing orders. Only restriction is that the transfer shall not be with malafide intentions and colourable exercise of administrative powers in the guise of administrative exigency. Depending upon the status of the employee, it can be challenged either before the labour court (if properly espoused by the labour union) or before civil court.
